Workers’ Compensation Claims and Medicare Set-asides: To Submit or Not Submit

Recently, CMS updated the Workers’ Compensation Medicare Set-aside User Guide by issuing amended guidelines regarding non-submit Medicare Set-asides. The initial announcement caused quite a stir, as CMS indicated that it would disregard all MSAs not submitted for CMS approval and require exhaustion of claimants’ entire settlement proceeds before CMS would pay any injury-related expenses. During this webinar, attorney Melisa C. Zwilling will explain the formal, final guidance that was issued regarding non-submits and cover the options available to show consideration and protection of Medicare’s interests in appropriate workers’ compensation settlements.
