Recently, CMS updated the Workers’ Compensation Medicare Set-aside User Guide by issuing amended guidelines regarding non-submit Medicare Set-asides. The initial announcement caused quite a stir, as CMS indicated that it would disregard all MSAs not submitted for CMS approval and require exhaustion of claimants’ entire settlement proceeds before CMS would pay any injury-related expenses.
